Terms of Service

These Terms of Service ("Terms") govern your use of BuzzerBeater (the "Service"), operated by Goodbye Paradise ("we", "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

BuzzerBeater lets hosts run Jeopardy-style buzzer games and lets players join rooms from any browser. Free and paid ("Pro") tiers are available.

2. Accounts

You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account. If signing up on behalf of an organisation, you confirm you have authority to bind it. Individuals must be of legal age to contract.

3. Acceptable use

You agree not to misuse the Service. You must not:

• Use the Service unlawfully or in violation of others' rights;
• Submit fraudulent, abusive, harassing, or spam content;
• Infringe intellectual property rights;
• Probe, scan, scrape, overload, or otherwise interfere with the Service or its security;
• Upload malware or attempt unauthorised access.

4. Your content

You retain ownership of content you create (such as boards and questions). You grant us a limited, worldwide licence to host, store, and process that content solely to operate and provide the Service.

5. Intellectual property

The Service, including software, design, and branding, is owned by Goodbye Paradise and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not reverse engineer, resell, or circumvent technical limits.

6. Payments and subscriptions

Paid plans are billed on a recurring basis until cancelled. Payment, billing, tax, cancellation, and refund mechanics are handled by Paddle. By purchasing, you also agree to the Paddle Buyer Terms. See our Refund Policy for details.

7. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Service availability

We work to keep the Service reliable but do not guarantee uninterrupted or error-free operation. Features may change over time.

9. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. You may stop using the Service at any time.

10. Warranty disclaimer

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Indemnity

You will indemnify us against claims arising from your content, unlawful use of the Service, or breach of these Terms.

13. Changes

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Goodbye Paradise is established, without regard to conflict-of-laws principles.
